Mental Health Act - overview for emergency medicine
The Mental Health Act (MHA) provides the statutory framework in England and Wales for detention, assessment and treatment of people with a mental disorder when compulsory powers are required. In emergency medicine the MHA intersects with police powers, emergency department (ED) workflows and the Mental Capacity Act (MCA).
The statutory Code of Practice is the primary operational reference and should be consulted for legal tests, procedural safeguards and patients’ rights (Code of Practice effective 1 Apr 2015; updated guidance 2017).
For ED‑specific operational detail about police removals and timing, see the RCEM Section 136 guide (Dec 2025, reviewed Apr 2025). For MCA/MHA interface and capacity issues in the ED see RCEM MCA guidance (Feb 2017).
Guidance on who may act as Section 12 doctors and approved clinicians is on GOV.UK (approval instructions; 2013 with updates 2021).
This section summarises the MHA material most relevant to acute practice, highlights ED operational points and gives practical checklists for assessment, documentation and escalation.
